Introduction
Understanding the fundamental requirements of job roles within a business is crucial for various purposes, including effective hiring practices, competitive compensation structures, evaluating employee performance, and ensuring operational efficiency. Job analysis, which involves thoroughly describing a position from its duties to its compensation and work environment, plays a pivotal role in this process. While typically associated with pre-employment procedures, regular job analysis for filled roles is equally vital as it facilitates appropriate professional development opportunities and sets employees up for success (What Is Job Analysis? An Introduction [Updated for 2021], 2021).
Categories of Employees
Employee classifications serve to identify individuals exempt from Fair Labor Standards Act (FLSA) regulations and dictate their benefits eligibility (7 Employee Classification Types and How They Compare, n.d.). Among the primary employee types, full-time employees constitute the majority, typically working forty hours per week with fixed compensation structures and access to company benefits. Conversely, part-time employees work fewer than 30 hours weekly, offering flexibility suitable for students, those seeking supplementary employment, or retirees. Contract employees work for a defined duration with specified hours, often renewable upon completion, while independent contractors, although similar, aren’t on the company payroll and offer greater scheduling autonomy. Despite cost benefits, hiring contractors and independent contractors poses managerial challenges and legal liabilities, including limited control over work supervision, equipment, and potential legal claims (7 Employee Classification Types and How They Compare, n.d.).
Temporary employees fulfill short-term roles, often covering for absent full-time employees or seasonal positions, while on-call workers remain available during specified hours but may not actively perform duties throughout. Volunteer positions, lacking compensation, vary in commitment levels and primarily attract individuals with other primary occupations, commonly found in healthcare, education, and community service sectors.
Business Roles
Within Sweet Delights Bakery, administrative assistants and customer service representatives represent critical roles. Administrative assistants support daily operations, requiring organizational skills, confidentiality, and effective communication, while customer service representatives serve as the primary point of contact for customer inquiries and issues. Both roles are full-time, offering competitive compensation packages (TopResume Editor, 2016; Workable, 2013).
Diversity, Gender, Harassment
Promoting diversity, equity, and inclusion (DE&I) is imperative for modern organizations, encompassing differences in ethnicity, race, gender, sexual orientation, age, and other factors. Harassment, a form of employment discrimination, violates various laws and protections, necessitating proactive measures to ensure a respectful workplace environment (Cooper, C, 2023; U.S. Equal Employment Opportunity Commission, n.d.).
Two Protected Classes
Employees are shielded from discrimination based on various factors, including race, religion, sex, age, disability, and genetic information, with legal protections extending to applicants, current, and former employees (Equal Employment Opportunity Commission, n.d.).
Neutral Requirements
Employers must adhere to neutral employment practices to prevent discrimination throughout the hiring process, emphasizing clear job descriptions and fair recruitment strategies. Pre-employment screening services aid in mitigating recruitment risks, including negligent hires and falsified credentials (5 Recruitment Risks & How to Mitigate Them | ShareAble for Hires, 2020).
Employment Law Impact
Employment laws govern various aspects of the workplace, from safety to benefits, confidentiality, and anti-discrimination measures, with non-compliance exposing businesses to legal liabilities and financial penalties.
Liability Exposure
Mitigating liability exposure entails establishing structured business practices, acquiring insurance coverage, and maintaining comprehensive documentation. Liability insurance offers protection against potential damages and legal expenses, although legal requirements vary by state (Choma, A. A., 2008).
